These Terms of Use ("Terms") govern your access to and use of the KapExx platform ("Service"), operated by KapExx ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
KapExx is a real estate investment analysis platform that provides tools for analyzing potential property investments, including cash flow calculators, return metrics, and property data lookups. The Service is offered on a subscription basis with multiple tiers.
ALL OUTPUT FROM KAPEXX — INCLUDING CALCULATIONS, ESTIMATES, PROJECTIONS, METRICS, AND PROPERTY DATA — IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. KapExx is an analytical tool, not an advisor. Nothing on the platform should be interpreted as a recommendation to buy, sell, or hold any property or investment.
Real estate investment involves significant risk, including the possible loss of principal. Past performance is not indicative of future results. All projections and estimates generated by the platform are based on user-provided inputs and third-party data sources, and may not reflect actual future performance. You should consult a licensed financial advisor, real estate professional, accountant, or attorney before making any investment decision.
You must be at least 18 years of age to use KapExx. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
KapExx offers paid subscription plans billed on a monthly basis. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — we do not offer refunds for partial months.

The address auto-fill feature uses property data provided by RentCast. This data is sourced from public records and third-party databases and is provided "as is." We make no warranties regarding the accuracy, completeness, or timeliness of third-party data. Property value estimates, rent estimates, and tax data are estimates only and should be independently verified before relying on them for investment decisions.
All content, features, and functionality of the KapExx platform — including but not limited to the software, design, text, graphics, and logos — are owned by KapExx and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, KAPEXX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR FINANCIAL LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless KapExx and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Kentucky.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
